A bill that could spare emergency room doctors and other emergency medical care providers from healthcare lawsuits passed the Senate Health Regulation Committee in quick order Thursday.

Senate Bill 1474, sponsored by Sen. John Thrasher, R-Jacksonville, Chair of the Republican Party of Florida, passed 5-2.

Unsuccessful in attempts to scuttle property insurance changes pushed by the industry, the state’s trial lawyer organization is turning its attention to a potentially more sympathetic target: Gov. Charlie Crist.

The Florida Justice Association is asking the governor to veto SB 2044, an industry-backed property insurance package that, among other things, makes it easier for companies to raise rates and requires policyholders to prove they are replacing the items that have been destroyed.

Victims of medical malpractice and their family members gathered today in Tallahassee to lobby against legislation that would cap damages against emergency room personnel.

The Florida Justice Association (FJA), which represents trial attorneys, organized a news conference for the victims and their family members.

Pointing to the 20 people around him, who were all carrying signs with photos of their loved ones impacted by medical malpractice, Marcus Michaels of the FJA said, “These are the representatives of the human cost of medical negligence.”

Legislation moving the burden of proof from retailers to injured plaintiffs passed the House Criminal and Civil Justice Policy Council and will be brought to the House floor, but Republicans and Democrats alike agree the bill still needs work.
